PHOENIX INTERNET’S ACCEPTABLE USE POLICY (AUP) relates to all Phoenix Internet products and services and applies to all Phoenix Internet Subscribers and third parties under their control. This AUP is not exclusive and is in place to protect both Phoenix Internet and Phoenix Internet Subscribers. Phoenix Internet reserves the right to make changes to this AUP at any time.

AUP – EMAIL

Subscriber shall not do any of the following or permit any third party under its control to do the following:

  1. Participate in bulk emailing (SPAM). Bulk emailing is defined as sending unsolicited mass mailings or advertisements to email users. This applies to users…
  2. Channeling SPAM through Phoenix Internet’s mail servers.
  3. Originating or channeling SPAM through any device or node utilizing Phoenix Internet’s network to connect to the Internet.
  4. Channeling SPAM through a 3rd party mail server using a Phoenix Internet account as an email drop for responses.
  5. Channeling SPAM through a 3rd party mail server using a mail server (utilizing Phoenix Internet’s network) as an email drop for responses.
  6. Falsify email header information (SPOOFING).
  7. Post a single article or advertisement to more than ten (10) Usenet or other news groups, forum, mailing lists or similar groups or lists.
AUP – FILE SHARING

Subscriber shall not do any of the following or permit any third party under its control to do the following:

  1. Post, transmit, or distribute any information or software which contains a virus, worm, cancel bot, or other harmful component designed to violate this AUP or any other Internet Service Providers AUP.
  2. Post, transmit, or distribute any copyright, trademark, trade secret or other intellectual property without proper authorization.
  3. Post, transmit, or distribute any Child Pornography.
  4. Post, transmit, or distribute any unlawful or illegal information of any kind, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any local, state, national or international law, including without limitation the U.S. export control laws and regulations.
  5. Participate in always on Peer-to-Peer file sharing.
AUP – MISCELLANEOUS

Subscriber shall not do any of the following or permit any third party under its control to do the following:

  1. Initiate Denial of Service (DoS) attacks through Phoenix Internet’s network targeting Phoenix Internet, Phoenix Internet Subscribers, or any other third party.
  2. Initiate any criminal activity which has a source or a destination within Phoenix Internet’s network.

Should Subscriber discover that any of its authorized users have committed a violation of the above rules, Subscriber must take reasonable steps to enforce this policy with authorized user. Failure of Subscriber to comply with this AUP will automatically cancel Subscriber’s Phoenix Internet account(s). All cancelled account(s) due to AUP violations will be liable for all cancellation fees as specified in the terms and conditions of the Subscriber’s contract.

AUP – COMPLAINTS

Complaints to Phoenix Internet should be addressed to abuse@phxinternet.net and follow the following guidelines:

  1. Be specific as to the nature of the complaint (i.e. UCE, Usenet Spam, etc).
  2. Include a copy of the offending message/article with full message or article headers included.
  3. Include a trace route or WHOIS output that demonstrates transit through Phoenix Internet’s network to one of the responsible parties; or that they are a networking Subscriber of Phoenix Internet or one of Phoenix Internet’s networking Subscribers.
